Buda Faces Legal Setback in Kanabargi Residential Project Development, ET RealEstate

BELAGAVI: The Belagavi Urban Development Authority (Buda) has faced a setback again in the High Court, in connection with the use of 29 acres of notified land for the residential scheme No-16 in the Kanabargi area.

Buda notified a total of 160 acres of land for the residential project in 2007. However, the project has been pending for the past 17 years because the farmers owning 29 acres decided to fight a legal battle, due to which the whole project came to a halt.

There are several residential buildings owned by the farmers on 29 acres of land, and the they do not want to lose them. Earlier, the High Court bench of Dharwad had given a verdict in favour of the farmers.

Buda had appealed the double bench, where it faced a setback on Wednesday. “It is a technical issue, and we will decide on appealing the verdict of the High Court double-bench,” said Buda commissioner Shakeel Ahmed, speaking to the TOI.

Meanwhile, the farmers of the remaining 131 acres had given their consent to implement the residential project, constantly putting pressure on the Buda to move forward. These farmers have given their consent, accepting 50:50 share of the developed land.

Following pressure from farmers, Buda recently called the tender for development of the acquired land, obtaining permission from the urban development department. When asked, Buda commissioner said: “There is no need for recalling the tender as we had called a tender for the development of 131 acres of land only, which is already in our hand. Thus, as of now, there are no hurdles for the implementation of the project,” he clarified.

Buda is facing huge pressure as it hasn’t developed even a single residential layout in the past two decades, due to which the land rates in the city have skyrocketed.
