E-khatas not capturing full property information, say Bengaluru flat owners, ET RealEstate


BENGALURU: Flat owners have alleged that the e-khatas issued by BBMP are not capturing the complete details of ownership of the land on which their apartment complexes stand.

The Karnataka Home Buyers Forum has said despite the ownership of the undivided share (UDS) of the land on which apartment complexes stand being mentioned in the schedules of the registered sale deeds and the same being available in the state’s Kaveri Online database, the civic agency’s online system is not mentioning the complete details in the e-khatas being issued for their flats.

According to homebuyers, sale deeds usually contain three schedules: Schedule A gives the extent and details of the entire land on which the properties stand, Schedule B mentions the quantity of UDS the buyer is purchasing, and Schedule C has details of the flat being purchased.

Commander (retd) LS Surendra of the forum said, “The e-khata issued for apartments is fundamentally incomplete. While it mentions the UDS, which is merely an entitlement and not a title, it fails to indicate the total project land — Schedule A property — as specified in the sale deed. Without this crucial detail, it is impossible to establish which documented property the UDS belongs to and who holds the actual title of the land.”

Homebuyers claim this omission potentially indicates a systemic loophole that creates inadequacy in the records pertaining to the ownership of their properties for which they have paid through their nose. They argue that since the money they have paid factors in the land on which their apartments stand and the same is reflected in schedule A of the sale deeds, the e-khata must reflect these details.

“Are apartments getting constructed in the air? Or on land? When the apartment is constructed on land, why are land details not captured in e-khatas issued to flat owners …Something fishy is happening in BBMP which requires investigation by vigilance,” the forum said in a letter to the BBMP chief commissioner and the revenue commissioner. The forum has also copied the letter to the high court registrar (judicial) and the Lokayukta.

Forum convener Dhananjaya Padmanabhachar said, “It’s surprising to see BBMP not pulling the land details of the apartment complexes from Kaveri Online and entering the same in e-khatas. Apartments are constructed on land, and if land details are missing from the e-khata, it raises a big question on the authenticity of the e-khata itself.”
