DTCP seeks HC nod to conduct flat allotment draw again in Gurugram, ET RealEstate

GURUGRAM: The flat allotment draw for 4S Aster Avenue 36 is under scrutiny after irregularities have surfaced. This has raised the possibility of a redraw for the flats in Sector 36 on Gurgaon-Sohna Road. District town and country planning department (DTCP) has filed a response in Punjab and Haryana high court seeking cancellation of the previous draw and permission for a fresh process. The next hearing is scheduled for April 1. If the court rejects the plea, the existing 51,586 applicants will be considered for a redraw, but no new applications will be invited.

4S Developers Pvt Ltd received a licence under the Affordable Housing Policy to develop the project on 1.5 acres of land. Following approval in Oct 2023, applications for 708 flats were invited on Nov 7. Out of 52,033 applicants, 447 were disqualified due to incomplete documents, leaving 51,586 valid entries.

However, when the e-draw was conducted on Jan 27, 2025, only 2,200 applicants were considered due to a technical glitch, instead of the full list. The 708 successful applicants were primarily from Sohna, sparking concerns over bias. Several applicants filed complaints, prompting a review.

Senior town planner Renuka Singh escalated the issue to director Amit Khatri, who immediately halted the allotment process and appointed a three-member investigation committee led by chief town planner (IT) BK Saini. The committee later recommended cancelling the draw.

Meanwhile, some successful applicants challenged the cancellation in court. With three hearings already held, the HC session on April 1 will determine the next steps. DTCP urged the court to allow a fresh draw to maintain fairness.

The case has also raised broader concerns over the transparency of Haryana’s e-draw mechanism for affordable housing. Homebuyers have demanded greater scrutiny and systemic reforms to prevent such irregularities in future allotments.
