EOW Mumbai files FIR against four for mortgaging flat twice, ET RealEstate

MUMBAI: The city’s economic offences wing (EOW) have filed an FIR against four partners of a company who mortgaged their flat with a money lender and availed a loan of Rs 6.4 crore. However, they did not return the loan amount nor did they pay the full interest. The accused mortgaged the same flat with another company and took more loans.

All the accused, who are in the construction business, are relatives and stay at Malabar Hill.

The complainant, a Colaba resident, told the police that his wife is an authorised money lender. The accused mortgaged their Worli flat, which has an area of 2,144 sq ft with three car parking spaces, and took a loan of Rs 6.4 crore on a yearly interest of 18%. The loan was for a period of five years, and a mortgage deed was also registered.

Police said that in June 2023, the complainant saw an advertisement/notice published in a newspaper by an advocate who stated that his client was buying the Worli flat and it was mortgaged with a company.

The advertisement stated that if the flat was mortgaged with more people, they should inform them. The complainant then made inquiries and learnt that the accused partners had kept several properties, including the Worli flat, as mortgage with the company and took a loan of Rs 50 crore from the company.

The EOW conducted a preliminary enquiry (PE) and registered the case.
