Ghaziabad civic body to now issue 15-day notice before a demolition drive, ET RealEstate

GHAZIABAD: The Ghaziabad Municipal Corporation has adopted the state govt’s Jan 27 norms for demolishing unauthorised and illegal structures. According to the rules, property owners must receive a show-cause notice via registered post at least 15 days before any action, or within the timeframe specified by local municipal laws, whichever is longer. The notice must also be visibly displayed on the structure.

In order to ensure transparency, officials must email demolition notices to the district magistrate’s office, which will issue automatic acknowledgements. These measures aim to prevent unauthorized demolitions and ensure proper documentation, officials said.

“The DM shall designate a nodal officer and also assign an email address and communicate the same to all municipal and other authorities in charge of the building regulations and demolition,” said an official.

The notice shall also contain details regarding the nature of unauthorised construction, details of specific violations, and the grounds of demolition.

“The notice should also specify the date on which the personal hearing is fixed and the designated authority before whom the hearing will take place,” the official added.

Previously, in Oct 2020, the GMC had received flak when it carried out a major demolition drive in Shanti Nagar amidst stiff resistance from locals. A battalion of PAC and local police had a tough time evicting occupants from their houses and had to drag them out. The new guidelines will provide clarity on how to carry out such a drive in the future, officials said.
