Maharashtra govt yet to clear panel’s recommendation to reduce deemed conveyance documents, ET RealEstate


PUNE: A high-level committee’s recommendation to reduce documents for deemed conveyance awaits the state government’s approval more than a year since the proposal was submitted.

The committee submitted the proposal in October 2023, reducing the required documents to seven instead of ten.

However, due to both Lok Sabha and Assembly elections, the govt had not considered the proposal for more than a year, a senior cooperation department official told TOI on Friday.

“We are again following up with the state government to clear this proposal which is expected to help societies carry out deemed conveyance to get land ownership,” the official said.

The state cooperation department said around 62% of the registered societies in the state lacked ownership of land. Of the 1.25 lakh registered cooperative housing societies, only 47,700 have secured conveyance while 78,116 societies do not have conveyance, a senior official said.

“The state housing department and cooperation department have to take a joint decision to clear the proposal,” a senior official of the cooperation department added. The proposal will again be placed before the state govt for discussion with hopes of clearance, the official added.

Committee members said they reduced the documents for convenience of societies, considering that many registered cooperative housing societies in the state still lack deemed conveyance or land ownership.

The eliminated documents are resolution for deemed conveyance in the general body meeting, a list of all flat owners’ stamp duty receipts, and a legal notice to the builder regarding deemed conveyance. The required documents are application form, registration certificate, property card of land, commencement certificate, undertaking by society members regarding documents and occupancy certificate status, agreement of sale, and sanctioned plans.

Members of the state housing federation said the state govt should address housing society issues for members’ welfare as their formation is now a fundamental right. The govt introduced the deemed conveyance option in 2010 to address developers’ delay in executing conveyance deeds. Under this provision, societies without conveyance can apply to the deputy district registrar (DDR) of co-operative societies for land ownership. “Many societies would be relieved if the documents were reduced,” said a member of the state housing federation

An official noted, “Many old housing societies have been complaining about not having the requisite documents. This has been delaying the conveyance process.”

Members of old housing societies claimed that the current number of documents required for executing deemed conveyance is excessive. “One has to approach various departments to get these documents, which is time-consuming,” said a member of an old housing society in Pune.

S Naik, a managing committee member of a housing society, said that the state government should speed up the proposal, so more societies can get deemed conveyance.
