NEW DELHI: A Supreme Court-appointed monitoring committee recently carried out a joint inspection of several non-notified roads in Delhi and found drastic commercial use of properties in violation of MPD2021 and Unified Building Bylaws.
The committee members asked the agencies concerned for immediate action, such as removing encroachments and submitting action-taken reports in a time-bound manner.
“After the coaching institute incident in Old Rajendra Nagar and, on the basis of several ongoing court cases of illegal construction related to Narela, central zones, etc., the activity of the monitoring committee has increased,” said an MCD official. He added that the joint inspection on Aug 6 was attended by senior officials from MCD, Delhi govt’s revenue department and DDA.
Like in 2018, the committee conducted a joint inspection in areas of south Delhi, including Chhatarpur, Chandanhola, Fatehpur Beri, Rajpur Khurd, Asola, Lado Sarai and Bhati Mines.
“The committee inspected Sant Shrinagpal Marg (100ft road) and found that this is a non-notified road. Despite this, a lot of commercial activities were found operating from multiple floors (including basements) of most of the premises on both sides of the stretch, in violation of the provisions of MPD2021 and UBBL 2016. Therefore, the deputy commissioner, south zones, was directed to revisit the area and issue notices to misusers under the relevant sections of DMC Act,” stated the directions issued by the committee.
“All actions against violators of misuse of premises must be carried out in accordance with the procedure prescribed by Supreme Court in its order dated Nov 2018, giving 48 hours’ notice to respond,” the committee stated.
On Chattarpur main road also, the committee found many commercial activities operational in the form of marble traders, wedding venues, hotels/guest houses, resorts and farmhouses. “Similar activities were also carried out from the interior of villages like Chandanhola, Fatehpur Beri, Rajpur Khurd, Asola, etc,” it said.
The civic body has been asked to provide a list of farmhouses wherein permission has been accorded to carry out social functions in accordance with MCD policy. The committee also found many nurseries and shops of stone dealers near Qutub Minar Metro Station on DDA land in the form of encroachments.
Besides the inspection of the above areas, director (land management), DDA, and SDM (Mehrauli and Saket), were directed to identify encroachers on agricultural or private land in some villages, take action and submit a report. These directions were based on complaints submitted to the monitoring committee office wherein it was alleged that on DDA notified land in village Satbari, Gumbad and Lado Sarai, unauthorised plotting and construction was going on unabated.
