Kalyan tehsildar directs police to register FIR on builder over forged land records, ET RealEstate

KALYAN: In a new development related to the 65 illegal buildings case in Dombivli, the Kalyan tehsildar has directed police to register an offence against a developer who allegedly prepared forged 7/12 land records and a non-agricultural land certificate to construct one of the unauthorised structures in Ayre village.

Shiv Sena (UBT) district president Dipesh Mhatre, who has been following up on the revenue department’s action in the case, obtained land records of some of the errant builders and found that one of them had prepared the forged documents. He then informed the Kalyan revenue department.

Tehsildar Swapnil Shejal said that revenue department officials investigated the building’s land record submitted by Mhatre and found that the documents were forged. Shejal then asked Ramnagar police to file an FIR against Sai Developers partner Shalik Bhagat.

Shejal also wrote a letter to MahaRERA seeking the 7/12 documents submitted by the other 64 builders for verification.

In Nov 2024, the Bombay high court had directed that the 65 buildings constructed illegally in Kalyan-Dombivli by developers using forged RERA certificates be demolished.

Petitioner Sandeep Patil has dashed off a letter to MahaRERA demanding that penalty be imposed on the errant builders under Section 60 of the RERA Act — fine to be imposed on project costs on developer for providing false information while applying for RERA certificate.

Patil told TOI, “In this case, the RERA still has not imposed any penalty on the builders. Hence, I demanded that before the demolition of these 65 buildings as per the Bombay high court order, the MahaRERA should first estimate the cost of the projects to facilitate the collection of a 5% penalty from the developers, which could then be allocated towards compensating the affected homebuyers.”
