Madhya Pradesh HC issues bailable warrant against Bhopal collector in RERA case, ET RealEstate

BHOPAL | JABALPUR: The MP high court issued a bailable warrant against district collector Bhopal in response to a contempt petition over his inability to execute an RRC against a builder issued by Real Estate Regulatory Authority (RERA) and direction from the high court for its execution.

The district collector Bhopal has been asked to be personally present in the court during the next hearing of the case.

The petition filed by Pratap Bhanu Singh that RERA had issued an RRC of Rs 23,26,363 in Oct, 2020 with an interest of 10% and the RRC was to be executed by the Bhopal collector.

After the RRC was not executed, he moved the high court. In July 2023, the high court while disposing of his petition asked the Bhopal collector to execute the RRC within 3 months.

The contempt petition was filed after the court order was not complied with within the time frame laid down by the court.

The bench of Justice Vivek Agaarwal, while hearing the petition, found that the contempt petition was filed in Feb, 2024 but no initiative has been taken by Bhopal collector so far for execution of the RRC.

Issuing a bailable warrant against the district collector, the court fixed the case for hearing on March 13. Advocates Kapil Duggal and Dhruv Verma appeared in the case for the petitioner.
