Madhya Pradesh HC orders FIR against two builders for land fraud in Jabalpur, ET RealEstate

BHOPAL|JABALPUR: MP High Court asked the Jabalpur SP and SHO of Omti Nagar police station in Jabalpur to lodge an FIR against two builders for allegedly selling a piece of land to three people by forging documents.

The bench of Justice Vishal Dhagat said that the probe report by Omti division CSP, which was handed over to SP Jabalpur, and the public prosecutor, both state that prima facie, a case is made out against the two builders— Adarsh Agarwal and Sushil Nigam. Therefore, it is imperative for the police to lodge an FIR against them on charges of fraud and other related sections under Bhartiya Nyay Sanhita (BNS), the court said.

Rajesh Kumar Jain from Jabalpur had filed a petition in the court, wherein he submitted that Adarsh Agarwal had signed an agreement with him to sell a piece of land but later sold the same land to two other persons in connivance with Nigam and took money from all the buyers.

The petition mentions that the Jabalpur Development Authority (JFA) had acquired the land from one Rania Chakroverty and later gave her 11 plots measuring 19,800 square feet. Chakroverty gave power of attorney to Agarwal to sell the plots in 2007-08.

Agarwal signed an agreement with the petitioner to sell the plots, for which Jain had paid Rs 45 lakh to Agarwal. Agarwal also produced a power of attorney signed by Chakroverty, stating that the owner of the plots would be Rajesh Kumar Jain. Subsequently, he, along with Nigam, struck a deal with Neeraj Gupta and Omprakash Agarwal as well and took advance money from them.

On his complaint, SP Jabalpur had asked Omti division CSP to investigate the matter. The probe revealed that Agarwal and Nigam had committed fraud with the buyers. The public prosecutor also gave the same opinion, but an FIR against the two was not lodged.
