MADURAI: Madras high court recently dismissed a plea against the construction of Tidel Park in Madurai district.
The court was hearing the petition filed by R Mayilsamy, Secretary of Neer Nilaigal Matrum Sutruchoozhal Paathukappu Nala Sangam-Madurai North. The petitioner sought a direction to prevent the authorities from constructing the Tidel Park in Madurai district.
A division bench of justice G R Swaminathan and justice B Pugalendhi observed that the counsel for the petitioner was right in his contention that the land parcels were originally classified as Vandiyur tank and water catchment area. The court recently held that even in a water catchment area, no construction activities can be permitted.
However, the court was not able to grant any direction in this petition for the simple reason that the reclassification took place some 44 years ago. The revenue records were produced before the court.
As early as 1981, land parcels were reclassified as a fertiliser yard for Madurai corporation. Now, the corporation allotted the land for setting up Tidel Park. It is for a public purpose.
The court is not in a position to restrain the authorities from proceeding further, the judges observed and dismissed the petition.
