BENGALURU: The National Consumer Disputes Redressal Commission (NCDRC), New Delhi has ordered issuance of non-bailable warrant against Sushil Mantri for not complying with its order, in relation to the failure of refunding the refundable lump sum maintenance deposit collected from the flat owners residing at Mantri Residency on Bannerghatta Road.
According to the order issued by the NCDRC on January 31, 2022, Mantri Estate Management Private Limited and others had collected Rs 7,12,86,650 from 302 flat owners. It is said the maintenance contract with M/s Propcare Private Limited was done for a period of three years with effect from April 1, 2016 till March 31, 2019 and it is agreed that once the agreement is terminated or on expiry of the agreement, the refundable amount would be refunded to the flat owners.
According to the documents available with Bangalore Mirror, the maintenance agreement with M/s Propcare was terminated in February 2017. It is said that a temporary agreement was entered with M/s Propcare to continue the maintenance contract from April 1, 2017 till August 31, 2017 and thereafter the maintenance agency handed over the facility to the Mantri Residency Apartment Owners’ Association. It is alleged that in spite of many reminders and persuasions by the flat owners for the return of the deposit, the opposite parties failed to refund the amount and it compelled the flat owners to approach the NCDRC for redressal.“The respondents have paid the refundable lump sum maintenance deposit without interest amount to 137 flat owners. They are yet to pay the amount to the remaining flat owners,’’ said Rajagopal Sethuraman, one of the flat owners.
Meanwhile, NCDRC ordered issuance of warrant against Sushil Mantri.
