NIT rejects over 43.5k regularisation applications under Gunthewari Act, ET RealEstate


NAGPUR: The Nagpur Improvement Trust (NIT) has rejected 43,549 applications to regularize houses and plots under the Maharashtra Gunthewari Development Act 2001 as they were either constructed on reserved land or on sewage network.

So far, NIT has received 95,788 applications. Of these, 81,668 had also submitted relevant documents. January 31 is the last date for submitting applications.

NIT found 43,549 applications do not comply with rules. “It is not possible to regularize these properties as they were either constructed on reserved land or on sewage network,” said a senior official privy to the development.

The official said that even under Gunthewari, there are some basic rules of MRTP Act which need to be followed. “Construction cannot be done on any reserved land,” the official said.

Also, any construction on drain line, its buffer area or on roads cannot be permitted.

As per Gunthewari Act, the state government had directed NIT should control and regularize Gunthewari layouts in entire Nagpur city.

Under Section 3 of the Act, NIT invited applications from existing plot holders who had bought properties till January 1, 2001. Section 3 (1) clarified that after January 2001, demolition and transfer under the Act will not be regularized.

Accordingly, NIT had sent a proposal to the urban development department to regularize layouts after 2001. After getting permission to regularize Gunthewari schemes till December 31, 2020, NIT called for applications. The application process started from March 14, 2022.

Although 81,668 people have submitted documents for regularization, demands have been sent to only 3,699 people so far. Out of them, only 1,652 plots were regularized.
