GURGAON: Hearing a plea against allowing construction of stilt-plus-four floors on residential plots in the city, the Punjab and Haryana high court was told by govt on Tuesday that it will not give approvals till the next date of hearing on Aug 22, the petitioner’s counsel said.
The bench of justices Arun Palli and Vikram Aggarwal was hearing a petition by Gurgaon Citizens Council, which had sought a stay on govt’s policy allowing S+4 construction in the NCR city.
The petitioner told HC on Tuesday that it had first filed the plea against permitting S+4 houses in 2021.
Two years later, in 2023, the department of town and country planning (DTCP) told the court that it had suspended the policy and appointed an expert committee to recommend if S+4 construction should be allowed.
Before Tuesday’s hearing, the last time that HC took up the petition was on May 30 this year, when DTCP submitted an affidavit, saying that the expert committee’s report was under consideration.
But, on July 2, govt released its policy, permitting S+4 construction in Gurgaon.
The petitioner’s counsel Nivedita Sharma, citing this timeline, on Tuesday questioned how govt could go ahead with the policy without informing the high court as the plea was pending.
The bench directed additional advocate general, who was representing the govt, to submit all relevant documents related to the policy by the next hearing.
Senior advocate Nivedita Sharma also told TOI that the govt’s counsel assured the high court that it will not give any fresh approvals for S+4 construction and submit documents till Aug 22.
