Telangana amends property registration rules, to allow concessions for illegal layouts, ET RealEstate

HYDERABAD: The Telangana govt has amended its property registration rules for illegal layouts in the state, allowing registrations for properties in unauthorised layouts developed on or after Aug 2020. The municipal administration department issued a GO on Thursday to amend the Telangana Regularisation of Unapproved and Illegal Layout Rules, 2020.

Previously, these rules did not allow property registrations or offer any concessions on the penal amount for properties in illegal layouts. The new amendment now incorporates provisions for registration and a 25% concession in penalties. According to the updated rules, property registrations will not be allowed in unauthorised layouts unless the plots or layouts undergo regularisation. Building permissions will also not be granted unless regularisation takes place.

Under the revised guidelines, layouts where at least 10% of the plots were sold on or before Aug 26, 2020, will be eligible for registration under the layout regularisation scheme. “Any plots that were registered in unauthorised layouts, where at least 10% of the plots were sold through registered sale deeds before Aug 2020, will be permitted for registration,” the GO said. However, regularisation charges and pro-rata open space charges will be required for registration.

Additionally, the govt introduced a new provision offering a rebate on regularisation and open space charges for applicants who make payments by March 31. Applicants will have the option to pay the pro-rata open space charges when applying for building permissions. However, they will lose the 25% discount if payments are made after the deadline.

Chief Secretary S. Santhi Kumari said the GO is effective immediately, except in districts where the model code of conduct is in place due to the ongoing MLC elections.
