HYDERABAD: Justice Juvvadi Sridevi of Telangana high court has granted anticipatory bail to municipal commissioner P Ramakrishna Rao, who was booked by Cyberabad police based on a complaint from HYDRAA for granting building permissions in the buffer zone of Errakunta pond at Bachupally in Nizampet municipality.
The judge also agreed with the contention of the municipal commissioners association, which said that the TG b-PASS system had bypassed them and entrusted the task of granting or rejecting the building permissions to HMDA.
If the building permission is sought to be built in an area that is more than 1,000 square yards, the matter gets transferred to HMDA, senior counsel V Surender Rao said, making it clear that Ramakrishna Rao has no knowledge whether Maps Infra, the builder in the current case, got the permission or not.
The counsel said Ramakrishna Rao even alerted HMDA about the fact that the builder was seeking permission to raise structures in the FTL/buffer zone of the pond. Thereafter, the builder got relief from the high court and continued the construction activity, he said.
The judge saw no fault on the part of the municipal commissioner and granted him anticipatory bail on the condition that he should be available to the investigators.
In another case, Justice K Sujana quashed an FIR against MA Mukheem filed by Ameenpur tahsildar in an alleged govt land encroachment case and also on obstructing officials from discharging their duties. The judge said that in such cases public servants should file a written complaint before the magistrate.
