HYDERABAD: The Telangana Real Estate Regulatory Authority (TGRERA) has directed a builder to register its residential project, ‘RDB Coconut Grove Apartment‘, under the Real Estate (Regulation and Development) Act, and imposed a penalty of 6 lakh for non-compliance.
The order was issued following a complaint by Coconut Grove Flat Owners’ Maintenance Mutually Aided Cooperative Society Limited, which alleged that the builder failed to deliver promised amenities and left significant portions of the project incomplete.
The society, representing over 500 flat owners, argued that despite purchasing flats based on assurances from the builder, several critical facilities, including a clubhouse, outdoor gym, water connections, fire safety systems, and elevators, remained unfinished. The complainants contended that repeated representations to the builder went unanswered, forcing them to seek relief under the RERA framework.
In response, the developer claimed that the project’s building permissions were obtained in 2013, predating the enforcement of the RERA Act in 2017. The respondent further asserted that six out of eight towers were completed as per the agreed specifications and that possession was handed over to buyers. The builder also cited a legal dispute over land earmarked for the clubhouse as the reason for delays.
Authority Orders Compliance Within 90 Days
After reviewing the submissions, TGRERA determined that the project remained incomplete and lacked mandatory RERA registration. The authority held that ongoing construction and continued marketing of apartments mandated compliance with the Act. Citing a violation, the authority imposed 6 lakh penalty.
The order directs the builder to complete all pending works within 90 days and to register the project within 45 days. The builder was also prohibited from marketing or selling any units until registration was completed. Non-compliance might attract further penalties under the Act.
