GURUGRAM: MCG commissioner Ashok Kumar Garg has initiated disciplinary proceedings against a taxation department clerk for unnecessarily delaying a property ID correction file pending for eight months.
The commissioner has proposed a chargesheet under rule 7 (major penalty) of the Haryana civil services (punishment and appeal) rules, 2016.
The case involves Sanjay Dutt, a Sector 57 resident, who submitted an application for property ID correction on June 24. His new property ID required proper linkage with the correct old property ID; however, it was incorrectly linked. He subsequently requested amendments in the municipal records through the NDC portal to delink the wrong old property ID from his actual property.
The commissioner observed that the clerk’s actions demonstrated clear negligence, with the prolonged delay suggesting possible ulterior motives. Garg noted that the clerk failed to perform his official responsibilities efficiently and with integrity.
The commissioner concluded that these actions showed serious dereliction of assigned duties.
The clerk’s primary responsibility involved assessing applications submitted through the no-dues certificate portal, which was designed to store property-related information.
The role included reviewing documents and noting required modifications, including corrections, additions, removals, or other allowable changes as per governmental guidelines, rules, and policies. Subsequently, these cases were forwarded to senior officials such as zonal taxation officers or joint commissioners for appropriate directives.
“The movement in the digital file clearly shows that the matter was kept under your consideration for an unwarranted and inordinate delay of more than one month without any valid reason. Further, the records indicate that the property in question falls under Sector 57, a locality specifically assigned to you for handling such cases. You were responsible for examining the case in accordance with applicable rules and submitting it to higher authorities for appropriate action. It is evident that you caused unnecessary delay in resolving the matter, which appears to have been motivated by personal ulterior motives,” read the notice issued by the commissioner to the clerk.It further read, “Your conduct has caused undue hardship and mental agony to the taxpayer/applicant, tarnishing the reputation of Municipal Corporation, Gurugram. Furthermore, your actions are unbecoming of a public servant. You have failed to maintain absolute integrity, devotion to duty, and professional conduct as required under the Haryana civil services (conduct) rules, 2016, applicable to the Municipal Corporation, Gurugram.”
The clerk has been given 15 days to reply to the notice. “He will be given an opportunity to give an explanation in his defence and submit a written statement,” said a senior MCG official.
